CONTRACT FORMATION: A contract is basically an enforceable promise. The best way to get what you expect from another party is to define your expectations as clearly as possible prior to committing time, labor, money or other valuable consideration. I produce results for my clients by drafting contracts that achieve what they desire and also by inspecting contracts and advising my clients on contracts they have been asked to sign.
CONTRACT ENFORCEMENT: (1) Often, my first contact with a client involves discussion of my representation of them in a matter regarding a “broken” (breached) contract. The least expensive way of getting “most” or all of what you expect from a contract is to try to negotiate some remedy or cure with the other party to get things back to what you expected. In negotiating and settling difficult and potentially expensive disagreements “out of court”, I produce results for my clients. (2) On occasion, rational well considered words and negotiation fail to produce a result sufficient to avoid litigation. At this point, winning is the result my clients should expect me to produce.
